Terms & Conditions: Empower Gold 12 (fixed term contract membership)

1. Members can activate their 12 month – fixed term membership on their chosen month at time of sale. But all memberships and direct debits start on the 1 st of the chosen month.

2. At the end of your fixed term contract if not renewed or cancelled this will revert to a month to month membership and direct debit.

3. Termination on a fixed term contract must be within 14 days of the membership ending. Early termination (inside 12 months) requires payment of monthly savings at a rate of $35 per month pro rata.

4. Your fixed term membership can be placed on hold for a fee of $20 per month for a maximum of 2 months per year.

6. For all memberships – if there is a change in your medical condition that requires you to hold or cancel any membership, please speak to our management team. This is reviewed on an individual case basis, dependent on each situation and information from medical practitioners.

Terms and Conditions: Empower Flexi (month-to-month D/D membership)

1. The direct debit will begin on the 1st day of the month after your introduction offer or membership comes to an end. Any time prior to this will be pro-rated and can be paid at time of joining.

2. There is no minimum period with the month to month membership.

3. If you wish to terminate your contract with us, we require this in writing before the 15 th of the month to terminate the following month.

4. If you wish to change your membership to an Empower 12, this can be done at any time and once the new Ts & Cs are signed, the payment will convert to the chosen plan.

5. Your membership can be placed on hold for a fee of $20 per month for a maximum of 2 months per year – if the membership is cancelled a rejoining fee of $39 is applicable.

 

Terms & Conditions: All non ‘Empower 6/12/Flexi’ Memberships (purchased before 30/06/19)

Fixed Term Memberships; All fixed term or annual memberships (3/6/12 months) are valid for the stated period of 3, 6 or 12 months. Memberships have a flexible start date activated on the date of the first class booking/attendance after the point of sale unless specified otherwise by the purchaser at the point of sale, i.e. by choosing a specific start date. All fixed term or annual memberships (3/6/12 months) can be placed on hold for a minimum period of 1 month and for a maximum period of 2 months during any 12 month period. Exceptional circumstances notwithstanding such as hospitalisation or serious injury. Please request in writing to enable this facility a minimum of 10 days before the required hold period. Any monies scheduled to be paid during the 10 day cancellation period will be debited according to the agreed contract at the point of sale.

General Terms & Conditions:

1. All memberships, intro offers and class passes give access to each member of standard classes on the timetable. It EXCLUDES; guest teachers/classes, workshops, retreats or other special events.

2. All clients must complete the new member questionnaire before their first class. All risks must be understood.

3. To avoid disappointment, we ask all our members to book in advance into their chosen classes. Bookings can be made through the Mindbody app and can be made anytime up to the start of the class, if there are spaces available. Class bookings are open 7 days prior to the class.

4. If you have not booked in feel free to come to reception 15 mins before class and we will endeavor to book you in, however, if the class is full, unfortunately, we will be unable to immediately give you a place. If the class is full, we recommend you wait and see if there are any late cancellations or failure to attend, you can then take their mat.

5. If the class is fully booked you can add your name to the waitlist. If you are on the waitlist you will receive an email up to 3 hours before the start of the class. Please check your emails. Class waitlists change frequently as attendees reschedule their day. If you are on a waitlist there is a high chance of getting a class place.

6. Once you have made a booking, we request a minimum of 3 hours cancellation. This can be done on the Mindbody app. Due to the popularity of our classes, any late cancellations will be subject to a charge that is not covered by any membership.

7. All private 1:2:1 appointments require a minimum of 24 hours’ notice to cancel or reschedule to avoid any late cancellation charges. All 1:2:1s require full payment at time of booking.

8. All workshops, events and programmes deposits and/or full payments (whichever is applicable) are non-refundable but are transferable with prior notification no later than 3 days before the event. Workshops, events and programmes deposits and/or full payments (whichever is applicable) are due within 7 days of the emailed request by Empower studio. Empower Studio reserves the right to leave the clients reservation as ‘open’ and unsecured until payment is made.

9. You represent that you are in good physical health and have no undisclosed medical reason or impairment that might prevent you from your intended use of the facilities. You acknowledge that you have informed the Studio that you have no contraindications to exercise. You understand and acknowledge that Empower Studio will not, and cannot, provide you with any medical advice. If you have any health or medical concerns now or after you join the studio, you will discuss them with your doctor before using the participating in our classes. You must advise the teachers or management of Empower Studio of any situation that alters any previous disclosure that you have made in relation to your health and your use of the facilities.

10. Each member is responsible for their own belongings. Empower Studio is not responsible for any damaged, lost or stolen items while in or around the studio location. All personal property must remain in the changing rooms for the duration of the class. Mobiles are not permitted in the studio itself. The changing rooms will be locked at the beginning of each class and reopened at the end of the class.

11. Actively ignoring the safety rules and requirements of the studio or defaults in payment may result in cancelled memberships.

12. DDR SERVICE AGREEMENT, all Terms and conditions for your direct debit will be approved through our chosen payment facility. Ts & Cs will be given at time of signed direct debit form.

13. The Owner may, at its option, terminate your membership if (1) you fail to make payments or any payments or fees are late, (2) the monthly EFT payments or membership fees are interrupted or discontinued for any reason and you or your cosigner do not provide an acceptable alternative, (3) you fail to follow any membership policies or club rules or violate any part of this agreement, or (4) your conduct is improper and harmful to the best interest of the Studio or its members or (5) you fail to provide doctor’s approval for exercising if so requested. Termination is effective on the date a written notice is sent to your last known address. You are liable for all financial obligations until that date. The Owner also reserves the right to terminate your membership for any reason not stated above and if not prohibited by law. If your membership is terminated, you will receive a termination notice and a refund of any unused Minimum Term or Pre-paid membership fees.

 

OUR COMMITMENT TO YOU

1. Empower Studio makes every possible effort to deliver classes and private services as advertised on the timetable. However, the schedule is subject to change or cancellation without notice, due in part or in full, to any or all circumstances, whether expected/anticipated or otherwise. Empower Studio is not liable to refund, transfer or offer compensation of any kind for classes or appointments that are late, changed, full or cancelled for any reason. Furthermore, Empower Studio reserves the right to temporarily reduce/alter and/or cease its service(s) at any time during any calendar year. Under normal operation, this pertains to any or all NZ public holidays, environmental/health and/or any other unexpected events.

2. Empower Studio delivers exercise classes with an emphasis on correct technique and functional movement.

3. We won’t overfill our studio so that you have space to move. We cap our classes based on the specific class with most standard yoga classes having a maximum of 30 people.

4. We won’t charge you for the use of our yoga mats and/or props in the studio.

5. We will start and finish classes on time.

6. We will help you empower your health and your wellbeing for the future.

7. We will deliver our classes with a friendly smile.
